Abstract

This research aims to reflect on the position of women in divorce, particularly in the representation of children in child support actions. In the judicial context, it is possible to observe situations where parents use strategies such as not having a fixed income, hiding income, or assets, with the purpose of misleading the court, resulting in a minimal child support amount that does not reflect the children’s needs and does not align with the father’s actual lifestyle. Thus, when a standard amount is set in various cases, such as limiting it to 30% of the parent's salary or even less, this is what we call economic violence, as the mother will have to cover the remaining expenses, regardless of the income she earns monthly. This research follows an inductive methodology, as we will observe facts that characterize economic violence and use these observations to conclude that economic violence is subtly present in child support actions. We will also employ a deductive method to show that micro-violences are small manifestations of macro-violences, reproduced in daily life and often silenced, yet even subtle, they cause irreversible harm to the victims. The goal of this work is to highlight the real need for a judicial system that is attentive and sensitive to detecting such practices, as well as to use methods and tools to ensure that this behavior is pedagogically punished, and that there is a fair balance in the contributions between parents, always prioritizing the children's well-being.
