Resumo: Este estudo objetivou analisar se o Delegado de Polícia, diante de um fato flagrantemente desprovido de tipicidade material, poderia aplicar o princípio da insignificância ao caso ou se o reconhecimento da insignificância se encontraria restrito ao exame do Ministério Público e do Poder Judiciário. Alguns dos passos galgados para chegar lá foram identificar de que forma a aplicação do princípio da insignificância pelo Delegado de Polícia pode servir como obstáculo à movimentação desnecessária da máquina estatal e ao encarceramento indevido de pessoas diante da ausência de tipicidade material da conduta, bem como analisar a possibilidade e abrangência da atuação do Delegado na aplicação do princípio da insignificância. Para tanto, foi utilizado como método para coleta de dados a pesquisa bibliográfica, através do estudo levantado com base em livros, artigos científicos, revistas e documentos eletrônicos sobre o poder do Delegado de Polícia em tipificar condutas em face ao princípio da insignificância. A partir da análise de toda a problemática da pesquisa, foi possível perceber que o Delegado não só pode, como também deve aplicar o princípio da insignificância quando a ausência de tipicidade material for flagrante, de maneira a realizar uma primeira análise do fato concreto, a qual, apesar de não ser definitiva, o legitima como autoridade garantidora dos direitos fundamentais e evita a sobrecarga decisória nos órgãos do Poder Judiciário, o que impede a movimentação desnecessária da máquina pública. Enfim, por meio de todo o estudo realizado e das sugestões pedagógicas apresentadas foi possível confirmar o poder decisório e discricionário que possui a autoridade policial de analisar todo o conceito analítico de crime, a qual não é obrigada a instaurar inquérito policial ou lavrar auto de prisão em flagrante diante de uma conduta que não lesionou ou causou perigo de lesão a nenhum bem jurídico, visto que, possui não só o poder, mas também o dever de aplicar o princípio da insignificância ao caso investigado.
Abstract: This Study Aimed To Analyze Whether The Police Chief, in the face of a flagrantly devoid of material characteristic, could apply the principle of insignificance to the case or if there cognition of insignificance would be restricted to examination by the Public Ministry and the Judiciary. Some of the step taken together were to identify how the application of the principle of insignificance by the police chief can serve as an obstacle to the unnecessary movement of the state machine and the unnecessary incarceration of people in the absence of the material nature of the conduct, as well as to analyze the possibility and scope of the Delegate's role in applying the principle of insignificance. For this purpose, bibliographic research was used as a method for data collection, through a study based on books, scientific articles, magazines, andelectronicdocumentsonthe Police Delegate's Power to typify conduct in face of the principle of insignificance. From The Analysis Of The Whole Research Problem, it was possible to perceive that the Delegate cannot only, but also must apply the principle of insignificance when the absence of material typical it is flagrant, in order to carry out a firstanalysisofthe concrete fact, which , although it is not definitive, it legitimizes it as an authority that guarantees fundamental rights and avoid the decision overload in the organs of the Judiciary, whichpreventstheunnecessarymovementofthepublicmachinery. Finally, through all the study carried out and pedagogical suggestions presented, it waspossibletoconfirmthedecision-makinganddiscretionarypowerthatthepoliceauthorityh astoanalyzetheentireanalyticalconceptof crime, which is not obliged to initiate a police investigation or draw up a prison sentence. in flagrante delicto in the face of a conductthatdidnotinjureor cause dangerofinjurytoany legal asset, since it possesses not only the power, butalsothedutytoapplytheprincipleofinsignificancetothe case investigated.
