A regulamentação da atividade de lobby no Brasil : estudo da liberdade de ofício à normatização

Abstract

This monograph addresses interest groups and their direct interaction through persuasive instruments of decision-making linked to the Government, a practice known as lobbying. The justified by the recurrence and historical influence theme in the Brazilian political scene, for the long international experience in regulating the activity and the absence of the absence of the subject in the Brazilian doctrinal and legislative field. The research will be composed through the exploratory-descriptive method, based on bibliographical and documental research, fomented in scientific articles, books and national theses; a brief comparative analysis of foreign doctrine is also carried out. The research proposes to analyze which obstacles prevent the effectiveness of the regulation of lobbying in the country, analyzing the approved and contrary arguments pointed out by the specialized doctrine; as well as identifying the legal and constitutional elements that permeate the lobbying activity; to delimit the concepts of interest group, pressure groups and lobby; investigating the current scenario of regulation in Latin America and the main characteristics pointed out by international organizations and the United States of America, as it has the most extensive and complex legislative edition on the subject. Finally, the points raised by the Bills placed on the agenda of the legislative houses with the intention of regulating the pressure groups in the national territory, analyzing the convergences with the fundamental principles pointed out by the international Organizations, will also be object of analysis.
