A compreensão de diferentes atores sociais acerca das medidas socioeducativas

Abstract

With the aim to know what has been pronounced on socioeducational measures, this study aimed to analyze how different social actors who discuss the guarantee of rights of adolescents, including those who are in conflict with the law, comprehend and position themselves before the socioeducational measures in its different dimensions. Moreover, was investigated the understanding that these different actors have concerning the current scenario about adolescents in conflict with the law in its political aspects, the guarantee of rights, of State actions, as well as security; and its different forms of participation in the sense of enforce and give visibility to their struggles and demands. For this purpose was performed an analysis of the material that deals with these issues produced by three institutions: the Pastoral of the Minor, the National Council of Justice (CNJ) and the Secretariat of Human Rights, spaces that develop works with the theme of interest in our study. Thus, the different actors affirm the socioeducational measures as an important instrument for change the lives of adolescents. They point to the necessity for the socioeducational system is organized according to what was predicted by CAS and regulated in National System of Socio- Educational Services, both in terms of physical structure, as human resources. They understand that the scenario of socioeducative spaces are far from what was defined in the documents mentioned, recognized circumstances and criticized by the actors. Pointing to the malfunctioning to the conditions and limits of establishments for the application of measures, characterized by overcrowding, unsanitary conditions for the accommodations, the lack of minimum conditions of hygiene, lack of activities for teenagers and the lack of professionals who could guarantee access to certain services. Furthermore, they speak of the fragility of a network educational spaces (schools, NGO and other entities) to ensure the effectiveness of measures. Lastly, point to the need for participatio of all, the State and civil society so that the attendance for these adolescents become, in fact, secured appropriately. The recognition of this scenario is important not only to dramatize the plight of teens who are in conflict with the law, but to glimpse what needs to be achieved so that their rights are respected, as the claims of the movement of struggle for the rights of children and adolescents in the country.
